A recent survey by the family lawyers group Resolution brings home how little the general public understands the divorce process and despite the fact that getting on for half of all new marriages will end in divorce. According to the survey, nearly half of respondents think getting divorced will require a court case. Nick Bell a Partner at Winchester based solicitors Shentons comments: “The availability of non-confrontational dispute resolution procedures doesn’t seem to be clearly understood.”
A further finding was that 40% of respondents believe divorce can never be without conflict. Nick Bell comments: “Quite clearly we in the legal profession, and the Government, need to work much harder at explaining to the public that divorce needn’t be a battle-ground, and that non-court based methods of achieving divorce are readily available.”
